go conform with European privacy and data protection regulations
Sadly, the use of tawk.to within the the EU is not really legal, due to privacy and data protection concerns.
Lawyers and business advocates are telling us, we should stop using tawk - if we come across the wrong customer we could end up in legal trouble.
Fix this plz!

Usage of tawk.to is governed by tawk.to's online Terms of Service, tawk.to has automatically incorporated a Data Processing Addendum, which will apply to its processing of personal data, and covers GDPR.
Just as tawk.to is not able to negotiate its Terms of Service, it is not able to negotiate this Data Processing Addendum, and/or sign individual agreements with each of our users - You enter into a legally binding contract with tawk.to as a data processor through acceptance of our terms of service.
We have updated point 10 of our Terms of Service (https://www.tawk.to/terms-of-service/) to read:
10. You guarantee every end user the right to object to your processing of personal data relating to the end user and processed for the purposes of direct marketing. tawk.to is firmly committed to protecting the privacy of your personal information and the personal information of your customers. By using tawk.to, you acknowledge and agree that tawk.to's collection, usage and disclosure of this personal information is governed by our Privacy Policy.
Additionally, if:
(a) you are established in the European Economic Area (EEA);
(b) you provide goods or services to customers in the EEA; or
(c) you are otherwise subject to the requirements of the EU General Data Protection Regulation, tawk.to's collection and use of personal information of any European residents is also subject to our Data Processing Addendum.
Tawk.to as a Data Processor
The people you store in tawk.to as Contacts are your data subjects, and you are considered the data controller for this personal data. In our Terms of Service and Privacy Policy, we refer to this data as personal data.
Using the tawk.to app to manage communication with your customers means that you have engaged tawk.to as a data processor to carry out certain processing activities on your behalf.
According to Article 28 of the GDPR, the relationship between the controller and the processor needs to be made in writing (electronic form is acceptable under subsection (9) of the same Article). This is where our Terms of Service, Data Processing Addendum and Privacy Policy come in. These three documents also serve as your data processing contract, setting out the instructions that you are giving to tawk.to with regard to processing the personal data you control and establishing the rights and responsibilities of both parties. tawk.to will only process your Client Data based on your instructions as the data controller.

"The DPA and tools will all be available in your dashboard" - I can't find any data processing agreement on my dashboard. I've already read your information here: https://www.tawk.to/data-protection/dpa-data-processing-addendum/ but this seems to be no help either.
Please let me know how to proceed, since it's not legal using your service without a DPA.

Hi! Can you tell me please, if the consent form can be used in the offline mode? If not, what are the options to comply when offline? Cause we deal with a form that can't be edited so that we can receive the consent before visitors they send the message.

There is a new option in Settings: Data & Privacy. Visitor IP Tracking can be disabled here, which was something important for us for the GDPR. Still have to check the rest of the new features.

Small update. I have asked Junalyn by chat and they told me that team is aware of the GDPR and that it will be implemented before the deadline. I hope they will implement if before the deadline, so we can still use Tawk.to after May 25.

Just a tip, customers in the EU will have to give consent so their data is stored on US. This can be done by adding a mandatory checkbox. But then we need a retention policy...
Waiting for any update on all this matter of GDPR.

Yeah I'm sure they either loose a ton of European users or they simply have to go conform with the GDPR. There is no other way. They have to react or otherwise people start to search for other solutions... I'm sure some of us would be happy to pay money for tawk instead of paying user data. Otherwise I'm also sure that those users who continue using tawk will get massive problems with the law.
But yes, I agree. They just talk around without giving a concrete information. That's why they don't react on this topic anymore. Only logic thing for me to do now is search for another chat plugin. Simple as that.

We also need to know when Twak is GDPR conform. Additionaly we also need a "Data processing Agreement" that we have with all other Companies like Google, Amazon, Slack etc. right now.
